IMPORTANT: These Terms and Conditions are intended for use with NJ Home Maintenance Services estimates and service agreements.
These Terms and Conditions are incorporated into every estimate, proposal, work order, maintenance plan, invoice, and service agreement issued by NJ Home Maintenance Services (“NJHMS”).
By signing, electronically approving, paying a deposit, authorizing work, or permitting work to begin, the customer confirms that they have reviewed and accepted the estimate, scope of work, pricing, service limitations, and these Terms and Conditions.
Unless otherwise stated, estimates are valid for 14 calendar days from the date issued. Pricing is based on visible and reasonably anticipated conditions at the time of the estimate.
NJHMS will perform only the labor and services specifically described in the approved estimate. Work not specifically listed is excluded, even when it is near, connected to, or related to the approved work.
Photographs, verbal discussions, field observations, marketing materials, and general descriptions do not expand the scope unless the additional work is written into the approved estimate or an approved change order. The customer is responsible for confirming that all requested work is included before approval.
Unless otherwise stated, a 20% deposit is required to secure scheduling. Final payment is due immediately upon completion of the authorized work unless different written payment terms appear in the estimate.
The customer may not withhold payment for completed authorized work because of excluded work, concealed conditions, cosmetic differences inherent in repair work, or conditions that could not be corrected through the authorized service.
Past-due balances may be subject to collection activity and legally permitted collection costs, interest, filing fees, attorney fees, or other charges where allowed by law and stated in the applicable agreement.
A 3% credit-card processing fee will be added to credit-card payments, provided that the fee does not exceed NJHMS’s actual cost of processing the payment and is disclosed before processing. No credit-card surcharge will be applied to debit-card payments.
Scheduling timeframes are estimates and are not guaranteed unless NJHMS expressly agrees to a guaranteed date in writing.
The customer must provide safe and reasonable access to the property and all work areas on the scheduled service date.
Additional charges may apply when crews must wait for access, move customer property, return on another date, or perform work beyond the approved scope.
NJHMS is not responsible for concealed defects or pre-existing conditions not caused by its work.
Discovery of concealed conditions may require revised pricing, a change order, additional work, or suspension until the condition is corrected.
Changes and additions requested by the customer should be documented and approved before additional work is performed. A change order may include additional labor, materials, equipment, disposal, excavation, access, permits, or other costs.
When an urgent concealed condition must be addressed to prevent immediate damage or safely secure an active work area, NJHMS may perform limited protective work and document the condition and charge.
NJHMS may photograph or record work areas before, during, and after service for property-condition documentation, customer communication, quality control, employee training, insurance, warranty, payment disputes, and proof of completed work.
Project photographs that do not identify the customer or display sensitive information may be used in NJHMS’s portfolio, website, social media, training, or advertising unless the customer submits a written opt-out request before work begins.
11. Gutter Cleaning
Unless otherwise stated, standard gutter cleaning includes removal of accessible loose debris from the interior of the gutters and clearing accessible downspout openings. NJHMS may use hand tools, blowers, vacuums, hoses, flushing equipment, or other methods appropriate to site conditions.
Standard gutter cleaning does not automatically include:
Additional charges may apply for excessive debris, difficult guards, unusually high or steep roofs, unsafe conditions, detached structures, or nonstandard access.
12. Gutter Guards and Screens
Gutter guards, screens, covers, and protection systems may need to be removed, loosened, opened, or worked around to access the gutter. Removal and reinstallation are excluded unless specifically stated.
NJHMS is not responsible for damage to aged, brittle, corroded, improperly installed, discontinued, glued, caulked, nailed, screwed, or permanently fastened guard systems when reasonable access requires movement or removal.
13. Downspout Flushing and Underground Connections
Flushing an above-ground downspout does not include cleaning its underground drain unless underground drainage service is specifically listed. Water backing up at the base may indicate an underground blockage, collapse, improper pitch, roots, inadequate capacity, or unknown downstream connection.
14. Post-Cleaning Debris and Results
NJHMS will make a reasonable effort to collect debris generated during service. Small amounts of roof granules, dust, organic residue, splash marks, or fine debris may remain, particularly when gutters contain wet sludge or deteriorated roofing material.
Gutter cleaning is intended to restore accessible water pathways by removing loose debris. It does not guarantee leak-free gutters, proper pitch, drainage during every storm, stain removal, correction of roof or fascia defects, correction of underground drainage issues, or prevention of future clogging.
15. Plan Coverage and Scheduling
Maintenance plans provide the number of gutter-cleaning visits identified in the selected plan. Unless specifically stated otherwise, visits are billed individually as completed and are not prepaid for the full year.
| Plan | Intended Service Periods |
|---|---|
| Essential | Spring and October |
| Silver | Spring, August, and October |
| Premier | Spring, Summer, September, and November |
| VIP | March, May, August, October, and December |
Exact service dates are determined by NJHMS based on weather, leaf fall, route efficiency, access, employee availability, and safety. Month names describe intended service periods and are not guaranteed appointment dates.
16. Plan Pricing and Exclusions
Plan pricing is based on the property’s current configuration, reasonable access, ordinary seasonal debris, and continuation of the selected annual frequency. Pricing may be adjusted if the property changes, guards are added, debris materially increases, access becomes more difficult, or additional structures are included.
Repairs, underground drain cleaning, guard removal, roof washing, snow removal, and other services are excluded unless specifically listed.
17. Plan Cancellation
Plan pricing reflects the customer’s agreement to complete the selected annual number of visits. If the customer cancels the plan or prevents completion of the agreed visits after service has begun, a $150 early cancellation charge may be added.
NJHMS may suspend or terminate a plan for nonpayment, repeated lack of access, unsafe conditions, abusive conduct, material property changes, or work conditions outside plan coverage.
18. No Clog-Free Guarantee
Maintenance plans reduce routine buildup but do not guarantee that gutters, downspouts, underground drains, or roof-drainage systems will remain clog-free between visits. Properties requiring November service should generally select the Premier Plan rather than a plan ending in October.
19. Gutter Installation
Unless otherwise stated, new gutter installation includes the gutter, standard hidden hangers, standard outlets, ordinary end caps, and standard installation hardware required for the listed scope.
Downspouts, elbows, miters, funnels, conductor heads, specialty outlets, fascia, soffit, drip edge, flashing, underground connections, removal, disposal, painting, and carpentry are included only when specifically listed.
20. Fascia, Soffit, Rafter-End and Related Pricing
All fascia board replacement, fascia cap installation, drip edge installation, flashing installation, soffit repair or replacement, and rafter-end repair work is subject to a base installation charge of $389.00 per applicable repair category, plus the material and labor pricing listed below.
| Repair or Installation | Current Price |
|---|---|
| Fascia Board Replacement | $14.99 per linear foot |
| Fascia Cap Installation | $14.99 per linear foot |
| Drip Edge Installation | $14.99 per linear foot |
| Flashing Installation | $14.99 per linear foot |
| Wood Soffit Replacement | $29.99 per square foot |
| Ventilated Vinyl Soffit Replacement | $39.99 per square foot |
| Rafter-End Repair | $99.00 per rafter end |
The $389.00 base installation charge covers standard mobilization, setup, removal of affected materials, preparation, equipment use, and installation setup. Separate base charges may apply for multiple repair categories, separate work areas, elevations, or mobilizations.
Final pricing will be adjusted according to actual field measurements, material requirements, accessibility, elevation, site conditions, and the extent of concealed damage. Additional work outside the approved scope requires revised pricing or a change order.
21. Color and Material Variations
Color samples, photographs, screens, existing materials, and supplier charts may not perfectly represent installed products. NJHMS cannot guarantee an exact match to aged or weathered gutters, siding, roofing, trim, fascia, paint, or other materials.
Minor variations in color, sheen, texture, profile, seams, fasteners, sealant, or fabrication are not defects.
22. Fascia, Roof Edge and Structural Conditions
Gutters must attach to a sufficiently sound mounting surface. If rotted, damaged, uneven, inaccessible, improperly constructed, or structurally unsuitable fascia, soffit, roof decking, rafter tails, siding, trim, or framing is discovered, NJHMS may stop work, recommend repair, modify the installation method, issue additional pricing, or require another contractor to correct the condition.
23. Gutter Pitch and Appearance
Gutters require pitch toward outlets. Because rooflines, fascia, trim, and existing structures may be uneven, properly pitched gutters may not appear perfectly level compared with siding, windows, roof edges, or architectural lines. This visual difference is not defective workmanship when reasonable drainage pitch is provided.
24. Gutter Repair and Resealing
Repairs and resealing are intended to improve the specific condition listed in the estimate. They do not restore an aged system to new condition or guarantee that another section will not later leak, shift, separate, overflow, or fail.
Sealants may have visible differences in color or texture. Existing materials may retain oxidation, corrosion, stains, scratches, prior sealant, and repair marks. Full replacement may be recommended when the system is severely deteriorated.
25. Existing-System Compatibility
NJHMS cannot guarantee that new sections or accessories will perfectly fit discontinued, custom, distorted, improperly installed, or nonstandard systems. Reasonable field modifications may be necessary.
26. Underground Drain Cleaning, Hydro Jetting and Camera Inspection
Underground drain cleaning, hydro jetting, and camera inspection are intended to clean and evaluate accessible portions of underground exterior drainage systems. Because piping is concealed, NJHMS cannot determine the complete route, depth, configuration, material, capacity, or condition before service begins.
27. Pricing Per Drain Opening and Pipe Section
Pricing is based per individual drain opening and per accessible section of underground piping inspected or cleared.
Each service section extends from one accessible opening, downspout connection, catch basin, cleanout, inlet, junction, outlet, or termination point to the next connection or endpoint defining a separate section.
A customer may not select only the final or downstream drainpipe, outlet, or opening and request that the entire connected upstream drainage system be inspected or cleared under the price of one opening.
When multiple downspouts, drain inlets, branches, junctions, cleanouts, outlets, or separate sections require individual access, inspection, flushing, scoping, or cleaning, each is treated as an additional drain opening or service section.
28. Additional Drain Openings
The approved estimate includes only the number of drain openings and drainage sections specifically listed in the scope of work.
If technicians determine that additional openings, downspout connections, branches, cleanouts, inlets, junctions, outlets, or pipe sections must be accessed, inspected, scoped, flushed, or cleared, each additional opening will be charged at $479.00.
By approving the estimate, the customer acknowledges that each additional opening serviced beyond the original scope will be billed at $479.00. Whenever reasonably possible, NJHMS will inform the customer before servicing additional openings. Charges may be added to the final invoice and processed using the approved payment method or card on file, subject to applicable authorization requirements.
29. Four-Inch PVC Drainage Pipe Pricing
This price applies to standard 4-inch PVC drainage pipe installation only unless otherwise stated. Excavation, removal of existing piping, fittings, adapters, downspout connections, catch basins, cleanouts, trenching through difficult soil, roots, stone, concrete, asphalt, landscaping restoration, hauling, disposal, permits, and other site-specific work may result in additional charges.
Final pricing is based on actual installed footage, route, depth, access, soil conditions, fittings, connections, disposal, restoration, and concealed conditions.
30. No Guarantee That a Drain Can Be Cleared
NJHMS does not guarantee that hydro jetting, snaking, flushing, or camera inspection will fully open or restore a drain. The service charge remains due even when the line:
The service fee compensates NJHMS for mobilization, labor, equipment, evaluation, and attempted service, not solely for a successful outcome.
31. Camera Inspection Limitations
A camera inspection provides a visual assessment of accessible portions of piping at the time of service. It is not an engineering report, plumbing certification, structural evaluation, guarantee of pipe location or depth, or guarantee of future performance.
The camera may be unable to pass through blockages, collapsed sections, sharp fittings, roots, standing water, debris, offsets, traps, reductions, or inaccessible areas. Conditions may be obscured by dirty water, sediment, condensation, pipe material, lighting limitations, or camera position.
32. Underground Damage and Excavation
If a system is found to be collapsed, crushed, root-infested, disconnected, separated, back-pitched, undersized, improperly installed, or damaged beyond cleaning, excavation, repair, replacement, rerouting, grading, or additional drainage may be required at additional cost.
Unless specifically included, NJHMS is not responsible for restoration of lawns, plants, irrigation, paving, masonry, concrete, buried structures, or other property affected by necessary excavation.
33. Drainage Performance
Drainage performance may be affected by rainfall intensity, groundwater, soil saturation, settlement, freezing and thawing, roots, landscaping, grading, municipal restrictions, downstream capacity, pipe size, pitch, configuration, installation quality, and neighboring or shared systems.
Cleaning or repairing one section does not guarantee correction of every drainage condition on the property.
34. Cleaning Results
Soft washing and pressure washing are intended to improve exterior appearance. NJHMS does not guarantee complete removal of every stain, oxidation mark, rust mark, mineral deposit, efflorescence, artillery fungus, paint stain, organic stain, discoloration, or permanent defect.
35. Pre-Existing Surface Conditions
Cleaning can reveal or affect loose or oxidized paint, failed stain or sealer, brittle siding, loose mortar, deteriorated wood, cracked stucco, failed window seals, loose caulking, oxidized aluminum, damaged screens, and leaking doors, windows, vents, or fixtures.
NJHMS is not responsible for conditions existing before service or damage resulting from defective, deteriorated, loose, improperly installed, unsealed, or non-watertight surfaces.
36. Water Intrusion
The customer must ensure that windows, doors, vents, electrical fixtures, pet doors, and other openings are properly closed and watertight. NJHMS is not responsible for water intrusion caused by failed seals, open windows, deteriorated caulk, improper installation, pre-existing leaks, damaged siding, or other defects.
37. Plants and Landscaping
NJHMS will use reasonable procedures to reduce risk to nearby landscaping, which may include wetting, rinsing, covering, or relocating accessible items. The customer must identify sensitive, newly installed, unhealthy, rare, or high-value plants before service.
NJHMS cannot guarantee every plant will be unaffected because plant health, soil, temperature, sunlight, chemical sensitivity, and prior stress are outside NJHMS’s control.
38. Oxidation and Organic Regrowth
Soft washing may remove organic growth but does not correct oxidation, fading, chalking, permanent discoloration, or underlying deterioration. Mold, mildew, algae, moss, and other growth may return because of moisture, shade, vegetation, drainage, weather, or environmental conditions.
39. Workmanship Warranty
Any workmanship warranty applies only when expressly stated in writing in the estimate. A workmanship warranty does not cover normal wear, storms, wind, snow, ice, falling branches, animals, outside forces, settlement, structural movement, freezing, soil movement, groundwater, new debris, existing materials, adjacent systems, customer modifications, third-party work, improper maintenance, or manufacturer defects.
Warranty concerns must be reported promptly, and NJHMS must receive reasonable access to inspect the condition.
40. Limitation to Authorized Work
NJHMS is responsible only for work specifically authorized and performed by NJHMS. NJHMS is not responsible for unrelated property areas, prior contractors’ work, existing code violations, undisclosed utilities or systems, or future failure of aged, damaged, or improperly installed materials.
Nothing in these Terms and Conditions waives any right or remedy that cannot legally be waived.
41. Customer Concerns and Opportunity to Inspect
The customer must notify NJHMS promptly after discovering a concern. NJHMS must be given a reasonable opportunity to inspect and, when appropriate, correct covered workmanship before the customer hires another contractor or alters the work.
Emergency action reasonably necessary to prevent immediate damage should be documented with photographs, invoices, and a written description.
42. Property Ownership and Authority
The customer represents that they own the property or have legal authority from the owner to authorize the work. The customer is responsible for approvals from associations, property managers, landlords, municipalities, historical commissions, neighbors, and shared-property owners.
Unless specifically stated, permits, engineering, surveys, association approvals, and municipal approvals are excluded.
43. Entire Agreement and Governing Law
The approved estimate, these Terms and Conditions, written change orders, and attached notices constitute the entire agreement. Verbal promises or representations not included in the written agreement are not binding.
If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. New Jersey law governs this agreement.
NOTICE: Where applicable under New Jersey law, a residential customer may cancel a qualifying home-improvement contract for any reason before midnight of the third business day after receiving a copy of the approved contract.
Cancellation must be communicated to NJ Home Maintenance Services in writing. When a qualifying contract is properly canceled within the applicable cancellation period, payments will be handled as required by law.
Written cancellation notices may be sent to estimates@njhomemaintenanceservices.com or mailed to NJ Home Maintenance Services, 26 Lincoln Road, Butler, NJ 07405.
No separate signature or cancellation form is required within these Terms and Conditions. The customer may provide a written cancellation notice containing the customer name, property address, estimate or contract date, and a clear statement that the customer is canceling the agreement.
